This is smart. When I see an included gratuity, I usually don't tip. (Even if I usually would have tipped more.)

I have seen restaurants write “service fee x%” and then explicitly say “this is not a gratuity”, implying that patrons should still tip.

I see we’ve reached the Ticketmaster stage of the restaurant economy. Fees upon fees only disclosed at the final step.

It is included, by the fact you legally do not have to tip.
